The key stages of a Purchase Transaction – Step by Step
- The contract package is sent to the Buyer’s solicitor by the Seller’s solicitor. This includes an Information Form and Fixtures and Fittings Form completed by the Seller.
- Upon receipt, the Buyer’s solicitor carries out the necessary Searches. Depending upon the location of the property, these may include a Local Search, Water and Drainage Search, Environmental Search, Coal or Brine Search and/or Chancel Repair Search.
- The Buyer's solicitor checks the title and other information and raises any necessary Enquiries.
- The Buyer’s solicitor receives the Mortgage Offer from the Lender and asks the Buyer to sign the Mortgage Deed
- When the Search results and replies to enquiries are received, the Buyer’s solicitor prepares a report for his/her client.
- The Buyer signs the contract, pays the deposit and completion date is agreed by all parties.
- Contracts are exchanged by the solicitors. This is when the agreement to purchase the property is binding.
- Final searches are conducted
- The purchase is completed on the completion date. This is when the Buyer collects the keys and can move into the property.
- The Buyer’s solicitors pay the stamp duty and register the property in the Buyer’s name at the Land Registry.
The key stages of a sale, step by step
- The seller's solicitor obtains title deeds and sends a Contract package to the purchaser's solicitor. This includes a fixtures & fittings form and a property information form which are completed by the seller, together with a draft contract.
- Searches are conducted and enquiries are raised by the purchaser's solicitor. The seller's solicitor responds to those enquiries.
- The completion date is agreed and contracts and the transfer deed are signed.
- Contracts are exchanged and the deposit is paid.
- Any mortgage redemption figure is obtained.
- The sale is completed.
- Any mortgage is repaid and the sale proceeds are sent to the seller.
The key stages of a remortgage, step by step
- The title deeds and redemption statement are obtained from the current mortgage provider.
- The remortgage offer is received.
- Any searches required are carried out and the title checked.
- The mortgage deed is signed and a completion date is agreed.
- The remortgage is completed.
- Any existing mortgage is paid off.
- The remortgage is registered at the Land Registry.
